These Terms and Conditions govern all contracts concluded via the online shop peculets.com between the provider and its customers. Please read these terms carefully before placing your order.

1. Scope

These Terms and Conditions apply to all contracts concluded between Jens Neuhaus, Holthauser Str. 32, 44627 Herne (hereinafter "Provider") and customers (hereinafter "Customer") via the online shop peculets.com. The offer is directed at both consumers and business customers. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature.

2. Subject Matter and Services

Peculets.com provides a platform for the acquisition of phygital art. The subject matter of the contract generally includes the following services:
  • Purchase of special paper: The customer (typically an artist) acquires unpainted special paper equipped with NFC technology.
  • Submission and certification: The artist paints the paper and sends it back to us. We link the physical work via the integrated NFC chip to a digital certificate of authenticity (NFT) on the blockchain.
  • Sale of artworks: The finished, certified artworks are sold through our platform on behalf of the artists to end customers. The provider receives a commission for this service.

3. Conclusion of Contract

The presentation of goods in our online shop does not constitute a legally binding offer, but an invitation to place an order. By clicking the button "Order with obligation to pay" you submit a binding offer to purchase. A binding contract is only concluded when we accept your order by means of a separate order confirmation by email or by dispatching the goods to you.

4. Prices and Payment Terms

All prices stated are final prices and include the applicable statutory VAT unless stated otherwise. Any additional shipping costs are clearly indicated during the ordering process. Payment is made via the payment methods offered in the shop (e.g. credit card via Stripe).

5. Delivery and Shipping Terms

Goods are delivered by post to the delivery address provided by the customer. The delivery time is specified in the respective offer.

6. Special Provisions for Phygital Artworks (NFTs)

When purchasing a finished artwork, the customer acquires both the physical work and the associated digital certificate of authenticity (NFT).
  • Wallet creation: For the transfer of the NFT, a digital wallet is automatically created for the customer via our partner Crossmint, unless the customer provides their own wallet.
  • Duty to secure: The customer is responsible for keeping their wallet access credentials safe.
  • Purpose of the NFT: The NFT serves exclusively as a certificate of authenticity and provenance record for the physical artwork. No copyright or further intellectual property rights are transferred unless expressly agreed in writing.

7. Retention of Title

The delivered goods remain our property until all claims arising from the contract have been paid in full.

8. Warranty and Liability

Statutory warranty rights apply. We are liable without limitation for intent and gross negligence. For slight negligence — except in cases involving injury to life, body or health — we are liable only where material contractual obligations are breached.

9. Right of Withdrawal

Consumers are generally entitled to a right of withdrawal. Further details are set out in our separate withdrawal policy. The right of withdrawal does not apply to individually produced artworks (commissioned works).

10. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered seat of the provider. Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall not be affected.
